TERMS OF SERVICE

1. Agreement to terms

By accessing or using the SG Datalytics website and services ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Platform on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

If you do not agree to these Terms, you must not use the Platform.

2. Description of services

SG Datalytics operates a data marketplace that warehouses, curates, and sells structured datasets focused on Ghana across sectors including education, business, health, sustainability, agriculture, and the economy. Services include dataset browsing, subscription-based access, data downloads, and custom data collection requests.

3. Account registration

To access datasets beyond free previews, you must create an account and subscribe to a plan. You agree to provide accurate, current information during registration and to keep your account credentials secure. You are responsible for all activity under your account.

SG Datalytics reserves the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

4. Subscription plans and payment

We offer Starter, Pro, and Enterprise subscription tiers. Plan details, pricing, and features are described on our Pricing page. All prices are listed in Ghanaian Cedis (GH₵) unless otherwise stated.

• Subscriptions are billed monthly unless otherwise agreed.
• Payment is due at the start of each billing cycle.
• You may cancel your subscription at any time; access continues until the end of the current billing period.
• Refunds are not provided for partial billing periods.
• Enterprise plans are subject to individual agreements and custom pricing.

5. Dataset licensing and usage

Datasets purchased or accessed through SG Datalytics are licensed, not sold. Your usage rights depend on your subscription tier and are detailed in our Data Licensing page. In general:

• You may use datasets for internal research, analysis, reporting, and publication with proper citation.
• You may not redistribute, resell, sublicense, or publicly share raw datasets without written permission.
• Derived works (charts, reports, analysis) may be published with attribution to SG Datalytics.

6. Acceptable use

You agree not to:

• Share your account credentials with unauthorised users.
• Use automated tools to scrape, bulk-download, or systematically extract data beyond your plan's allowance.
• Attempt to reverse-engineer, de-anonymise, or re-identify individuals from datasets.
• Use datasets for any unlawful purpose or in violation of any applicable regulations.
• Misrepresent the source, accuracy, or provenance of data obtained from the Platform.

7. Intellectual property

All content on the Platform — including datasets, visualisations, branding, design, code, and documentation — is the property of SG Datalytics or its licensors and is protected by intellectual property laws. Nothing in these Terms transfers ownership of any intellectual property to you.

8. Data accuracy and disclaimers

SG Datalytics makes reasonable efforts to ensure data quality, accuracy, and timeliness. However, datasets are provided "as is" without warranties of any kind, express or implied. We do not guarantee that datasets are error-free, complete, or suitable for any particular purpose.

You are responsible for independently verifying data before making decisions based on it.

9. Limitation of liability

To the maximum extent permitted by law, SG Datalytics shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Platform or datasets, including but not limited to loss of profits, data, or business opportunities.

Our total liability for any claim arising from these Terms or your use of the Platform shall not exceed the amount you paid to SG Datalytics in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your access to the Platform at any time if you breach these Terms. Upon termination, your right to access and download datasets ceases immediately. Provisions relating to intellectual property, limitation of liability, and dispute resolution survive termination.

11. Changes to terms

We may update these Terms from time to time. Material changes will be communicated via email or a notice on the Platform. Continued use of the Platform after changes constitutes acceptance of the updated Terms.

12. Governing law

These Terms are governed by the laws of the Republic of Ghana. Any disputes arising from these Terms shall be resolved through negotiation and, if necessary, through the courts of Ghana.
